498a and 406

Recently the above two sections have been used by wife of one of my relative who is not staying with him since last one year . whether the fact of her absence from the house since last one year can be used as counter in this case to get anticipatory bail?

No sorry it can be filed anytime within 3 years regards ASHOK

U can use this as a ground in the AB. Motive of this complaint is only to harass as no complaint was lodged till one year. Nd mention tht all her belongings r taken away by her.
