I want to oppose an application filed u/s 317 Cr. PC for permanent exemption on the ground that the daughter of the accused is a handicapped and she needs to be attended daily and there is no other person than accused to take care of her. There is no affadavit filed along with the application ( because the facts mentioned in the application are false). Kindly answer:
Any judgement of Delhi HC, Supreme court to oppose this apploication.
Can we request the court to ask the opposite party to file an affadavit, kindly clarify on the role of affadavit u/s 317.
