302 or 306?

If police filed FIR under 302 section and if judge thinks that the case must be under 306 section. Can judge sentence the jail under 306 section?

Quick Summary
This discussion explores a legal query regarding FIRs filed under Section 302 (murder) of the Indian Penal Code. Specifically, it asks if a judge, upon reviewing the case, can decide that Section 306 (abetment of suicide) is more appropriate and subsequently sentence the accused under that section. The initial response suggests that a judge does have the authority to make such a change.
