Teacher's contract

What is the appropriate procedure to make the contract while appointing teachers in school. Shall we use stamp paper, which one shall we use, (Rs. 20, Rs.50, or Rs.100) can't make out the change. We are planning for condition that the employee has to repay two months salary if wants to quit except for health reasons or other genuine reason of transfer of the guardian if the employee is a female.

And can we deposit their original documents? We want to make it a balanced contract. Please suggest.

You may also offer to pay notice pay of 2 months.

The T&C of Contract of Employment should be equitable.

NO you can’t keep Original Testimonials of any employee as any kind of collateral. It is their property.

 

Employer can’t have any kind of lien on Educational Testimonials of employee.

Retention of Original Certificates of teachers/Employees would be violation of Bye Laws and you can even loose your affiliation e.g. as in case of 

AFFILIATION BYE -LAWS

26. Medical Certificate and Character Certificate etc.

c) Original degree/diploma, certificates along with certificate(s) of experience, if any; with

attested photocopies thereof. Original certificates will be returned after verification.

43. Service Books and Confidential Rolls

 

The original ceritificate / degrees shall be returned to the employees after verification and photostat copies kept in the personal files. School Authorities should not keep the original certificate with them.
