in my case the order if cat passed in 2014 was accepted by the department and implemented in 2015 but now they are filing a writ petition against that order. Is it legally viable?

Please post the material facts. What was the Order? How it has been implemented? What is the irregularity/illegality pointed out in the present Writ Petition? Please note that decision of the CAT is final and what has been filed is a writ of certiorari.

cat has set aside the order fo DA imposing penalty. this order was accepted by the department and allattended benefit incliding seniority in time scale is given. now after 2 amd half year they are contemplating to file a writ agiainst cat order.

is there estoppel on filing of w.p. against an order of the tribunal if the same is already accepted and implemented by the concerned authority?
