Whether i can file a petition uner it act to acmm and appear without advocate

(Querist) 11 May 2012 This query is : Resolved 
Dear Sir,

I request you to kindly give your opinion whether I may file a petition under Information Technology Act to ACMM and then appear before ACMM/MM without advocate and handle full hearings myself.

conduct ur case in court with the permission

a person knows his own case very well. so also if a person is well versed with law then he can fight his own case. and as stated by our expert and law of the land. any person can fight his own case.

Under the Advocates Act, only the advocates are the class of persons to practice in the court, but in exceptional cases the court can permit you to conduct your own case,provided that the court is satisfied that you are competent to handle your case. Just appear before the court and submit that you wish to conduct your own case and file an application in that regard.

"Ignorance of law is no excuse" punishment are based on this principle also. This indicates that every person should know the law of land. Since it is not possible for each and every person to learn and understand the same. The class of persons have done so and that sect of class is known as advocates and they are learned, owes the burden of others by representing.
As regards conducting ur case in person is not denied and need not to file any application in that regard. But whereas i u appoint any agent or advocate the procedure is to be complied i.e, an advocate has to file "Wakalat" and an agent other than advocate has to seek permission of the court.

Dear Mr. Goel,

Though I do agree partially with all the other advocates advice, the main thing needs to be seen is whether u would like to appear in person for the reason you feel that you could represent your case better or you don't want to spend unnecessarily. In case you know your case better and want to represent then simply informing the court that you want to appear in person will be enough. However, if there is any financial trouble then upon such event you can approach the appropriate court to seek legal aid service which is available free of cost for common man.
