Hello Team,
My sister is a divorcee and now she is about to get married. So we have decided for a court marriage. But the person whom she is getting married has hired a lawyer for the formalities to be done. We have provided all the relevant documents but they say that the divorce decree is not helpful we need the original petition. And if we do not have this document then we can show the bride as unmarried. We are deeply concerned about this as when we have all the relevant documents then why should we opt for an false document. My main concern is that today we are there for her but what will happen in future if she is blamed for those false documents. Can you please help me with this?

For court marriage under the Special Marriage Act,1954 only the certified order and decree of divorce required not the complete case file. I must have got 100s of such marriages under the Special Marriage Act,1954 and these very documents were attached with in their marriage case file. As far the complete case file, main petition etc. is concerned the certified copies of that too can be obtained from the Family Court were the divorce was finalised. You can apply for that and get it by making required fees for the same.

I agree with Mr. Mahajan. And false declaration of being unmarried may create legal issues in future. And confirm whether this idea is of the groom or his lawyer and also check the intention behind the same. Strictly refuse to sign on any such document which shall provide false information.

If the suggestion is made by the said Lawyer to you, then IT is good for nothing Lawyer that are seen/discussed daily at LCI also. IT seems to have something bad up IT’s sleeves for you. Make IT popular in your circle and blacklist permanently.

Don’t ever act in haste and submit wrong information/declaration and sign of false statement and/or submit forged document. These IT’s= Other party, IT’s Lawyer seems to have something bad up IT’s sleeves for you. The copy of petition is being demanded for future reference and use. You can yourself make out by common sense.
The question arises; since the query is posted by you, Do you want to share these documents!
If, NO why?
And If yes then apparently you have nothing as apprehension in your mind.
Neverthless, legal tangles are handled well when time comes with irrefutable evidences, and grounds of law and brilliance and intelligence of Presiding Officers.
Lawyers are permitted to argue in court and arguments are assessed and analyzed by court and decision is given by court.
If you have apprehensions don’t go for accepting offer of this relation.

Certified copies are obtained from same court that has decided the matter.
Apparent,y copies are desired for future,reference, record.

Certified copies of court record of particular case file that after finishing of case can be applied by anyone. You can do it yourself. Contact the copying branch of the district where divorce was granted. Why depend on their lawyer who may make excuses for it.
