Could a individual consider as a public when wrong happen to him done by a private hospital. Hospital can be charged for public nuisanse.

The facts are that a hospital treated a patient with dengue and recommends for blood test. The lab tested the blood samples of patient and reported dramatic fall in blood platlets and blood grouped as ab+. The patient then ask the hospital that they want another test at some other lab. The other lab which reported normal platelets count and blood grouped this time as a+. On this negligance of hospital and lab the complainant patient go for complaint to SDM of the zone. On this complaint the SDM order to shut down the Hospital and lab under sec 144 cpc by intial inquery. The charges frame considered as Public Nuisance. The Hospital urges that it is only a private nuisance as the wrong happens only to a individual. So my question is that if it is a public or private nuisance.
