Record of right of the land for ancestral property

(Querist) 14 March 2019 This query is : Resolved
my great-grandfather borrowed Rs. 2000/ from private lenders on by an un possession(not handover) mortgage in the year 1932 for an extent of Acres 200.In the year 1934 my great grandfather passed away. The creditors filed o.s in district court in 1941 and then got decree from the court on their favor. My great-grandfather's father cleared the decree debt and the creditors handover the landed property to some external person. And Transferred the property through a registered document as declaring in that document that they have received the cash of the decree debt.Further the property distributed to many others.
Now,i am being the 4th generation of the property.May I claim the property in highcourt and the property is still undivided from the last 3 generations.I want proper guidance regards the matter for to proceed further in the high court.

Yes this seems to be ancestral property of Hindu family where you by birth in the family have share as copacener, you can claim your share. You can move application for joining the court proceedings to claim your share in the property.

Your query does not seem to make any sense, as on one hand you say that after clearance of debt by the father of your great grandfather, but the property was handed over to some external person and registered in his name and redistributed to many other persons, and on the other, you lay your claim, as 4th generation successor on the property registered in some other\s name and further distributed among several other persons.

Both things cannot be correct at a time. So, before your claim on property, as for an ancestral property, you have to clarify, what action was taken by the father of your great grandfather or the successors of your great grandfather, etc., to claim back the property to the name of the original owner, i.e., your GGF, after the property was registered in some other's name and further distributed among several other persons. Also, who were they in whose name the property was registered and distributed after payment of debt money.

The facts, as posted, are less than convincing.
