Property booked by mcd with reason deviation/excess coverage

Hello Experts ,

I have question regarding properties which are booked by MCD with reason "Deviation /Excess coverage beyond sbp id xxx from stilt to third floor

What are consequences of buying such property and how to rectify such issue ? Property has Completion certificate as well but name is there in latest list from MCD . ? if buying this property is safe ? can this be rectified by paying fine etc to MCd ?

Better avoid purchasing it.You will have to incur huge expenditure to regularise it, that too may become futile.

Thanks sir for your quick response if there is some defined amount per SQFT multiplied by circle rate or it depends on MCD ? And can we legally get this building regularised ?

You can regularise it contact local advocate who may help you for charges etc.

'Buyer Beware' applies to property deals.
It shall be appropriate to get proper legal opinion from a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue/property/civil/DRT matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt , before signing or making payment.
This may cost some FEE but can defend long term interest and hard earned monies.


One should stay away from putting hard earned monies in such property(ies)!

If property is regularized/compounded by bye-passing the applicable rules, IT can be contested.
IT happens in almost MC's.

Demolition threat always looms.

you may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s, experienced colleagues, associations, etc and find a very able LOCAL counsel/Law firm specializing in concerned filed of law e.g; Revnue/Civil matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you after examining all case related docs, inputs, evidences on record.
One should not fall for IT’s and entities loitering at online portals to allure unsuspecting querists. There are many threads on such instances at LCI also.
Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law.
There are such very able counsels at each location.
Check for such counsels at LOCAL e.g; Revenue/Civil courts, HC, SC …

What are the deviations in the building for which it has been booked ?
When was the property sealed ?
Whether the EE or DC has passed order for sealing the property and which provision of law? Whether the booking order has not been challenged / assailed before Appellate Tribunal Tis Hazari Court ?
Knowingly, why and how you are interested in purchase of disputed property ?
