Land dispute

My mom and myself was attacked by own brother for entering our home, which is in our name. They attacked me and I was in the hospital. Path to the land passes infront of their home, which is common for both of us. Now they claim it's their own and we can't pass through it. Under which sections can I register complain . Can I complain directly to the magistrate ? Because the police people seems to be supporting them and they have made the case weak and insisting to close it by threat .please help me ..thank u

The land is in my name but the way to land in common for both my brother and me. They are blocking the path as well as attacked me and was in hospital for 2 days. So under which sections can I register and where should I register.

Better to discuss this in detail with your Local Advocate Or with Free Legal Aid Forums of the concerned Court and they would take care.You could file a Police Complaint with Local Police and if no steps you could complain to their superiors like SP or DSP or Assistant Commissioner etc. There could be some Result.When you go to court your case would be given priority if your mother is Senior Citizen. So Do not worry. Proceed as advised.

If i go to court , is it possible that they will pay more and bribe my own lawyer? They are bit richer and powerful than us . How can i avoid this, because i believe this happened in police station. I gave the case and they are threatening me

You need to lodge an FIR for the attacks made on you and your mother. As regards to the use of the common access, a civil action lies; however, in the given circumstances the matter could be place before the local adalalat (Legal Services Authority)
