Sec 380 theft at dwelling place

Respected expert I want to ask that why court refuse compromise in this case if it is happened once by a non criminal background person
Actually my brother has been charged under theft and amount also recovered within 1 hours by police . He has sent to jail and district court did not give bail and after 7 month my brother has punished by 2 years of imprisonment. Now our neighbors and we want compromise but court refuse it what to do plzz suggest

For cognizable state criminal complaint case like for theft, you need to file quashing petition u/s 482 CrPC in the High Court where the issue of compromise can be worked out not in the Session Court.

The stage of compromise was before pronouncement of judgment of conviction, now your brother has the only remedy of filing an appeal through your lawyer.
