Revision in high court

(Querist) 07 June 2018 This query is : Resolved 
Sir,
I filed a complaint u/s 380 and 120B which was dismissed by the ACJM. Against the dismissal of ACJM i preferred cr. Revision u/s 397 Cr. Pc. Which is also dismissed by the District judge. Now i want to move the petition in the high court. I hv been advised that petition can not be filed u/s 397 since the second revision by the same person is barred and the petition can be filed either u/s 482 cr pc or under article 227 of the constitution.
Please advise under which section or under which law would i file an application in the high court against the order of district judge.

Rightly told you that for high court you file petition under section 482 Cr.P. C read with Article 227 of the Constitution of India.

(2) In a case where under the Code of Criminal Procedure an appeal lies but no appeal is brought, then according to Sub-section (4) of Section 401, no proceeding by way of revision shall be entertained at the instance of the party who could have appealed.
