(Querist) 22 May 2018 This query is : Resolved
On 23rd April 2018 my cousin got married in Uttar Pradesh and within 3-6 day he and his family got to know that the girl is mentally disturbed and she did lots of weird things like running out of the home and lots till her stay. Then they called girls family to take her back along with her all the ceremonial gifts were also taken back by both the parties. After a week the bride's party bought lawyer and told us that we need to wait for 6 months for her treatment, there lawyer forcing us to bear 50 % of her future treatment. Please advice what to do?

Damn cheap bargain. Otherwise, your cousin is liable to bear full charges of the treatment of his wife. If not, he should be legally prepared to bear with maintenance charges, including the cost of treat for the whole of her life.

What is the diagnosis of the medical specialist; Psychiatrist?
Since how long the treatment was going on?

Why do you think that parents of the girl have not been courteous?

Without this Marriage proposal also anyway girls parents would have born the costs of her medical treatment.Let your cousin bear 1/2 of the expenses of the treatment. It's cheap. As opined by Dhingra Ji your cousin would have to bear the whole of maintenance charges and her treatment charges the whole of her life. Now instead he is asked to bear 1/2 of her treatment charges by her parents.

As a husband it becomes the complete responsibility of the husband to provide maintenance and expense for medical treatment for his wife, half the expenses for medical treatment is good bargain. However, what will be scenario after 6 months of the treatment, what is the guarantee that the woman shall be fit enough for resuming normal conjugal relationship with husband, that should be answered and if she is not getting normal, will the marriage be dissolved by mutual consent after 1 year of marriage as the separation of 1 year, stipulated for such divorce required to proceed in the Family Court.

Any event occurring later after 6 months cannot get an appropriate answer merely on assumptions. Your cousin, in all his sincere efforts, should better cooperate with his in-laws to help recover his wife from illness. He must wait for the end results for six months on their assurance.

Even otherwise also, a gift through kanyadaan if received in the shape of his wife that becomes his own sole responsibility and liability to maintain that in good shape of health, happiness and prosperity. It is not a one-sided affair to reject or accept, as and when liked. He could have used his discretion to reject her before getting married. It was for him only to make proper background checks before marriage. Only a rare kind of disease can be found incurable.

A person can not be judged as Psychopath for any misbehavior. In this modern world such issues are common like any other disease and it could be treated well also but it depends on the environment also. Even the environmental changes could lead to such behavior. A Good Advocate could strongly defend her if you and your family accuse her as mentally retarded. Better treat this with humanity and co operate in getting her well with your co operation in all aspects including the expenses. Presently she is your Legal Wife. Remember

Wrong suggestions by above repliers.

You should go for mutual divorce. Pay 1 time alimony and purchase divorce. That is the easiest way out for everybody.
Guest (Expert) 23 May 2018
Mutual Consent means an Agreement of both the Sides. Just like that the Mutual Consent Divorce can not be filed with out the consent of both.

Here the Wife is Rightfully and Legally demanding the money from her husband for her treatment and there by No Question of any Divorce.

I am shocked with our country laws but that girl's family hide truth about her mental health. What about that? Can't we file a FIR against bride's family? My cousin family can't bear her treatment expenses.
