Building of fabricated staircase in society premises

(Querist) 09 April 2018 This query is : Resolved
Hello,
To all those taking out time and helping the needful
Sir / mam, i have recently rented a property (entire 1st floor) in a society for commercial purpose.I also reside in the same society and have been a member since 20years.I desire to build a fabricated staircase for direct entrance to the property for easy walk in entry to customers as the concrete staircase of society is from inside portion of the building not visible from outside. The ground floor is also filled with retail shops and open to all.I have approached the members and committee as well and also offered to pay rent for the property thatll be used by me,but the society has been demanding a high rent for the area ( 30% of the rent amount) whereas i am willing to pay (10-15%) .On the other hand no shopkeeper on the ground floor has been paying any rent for the use of property ahead of their respective shops. They are saying that either pay rent or demolish the stairs as it is illegal. Coming on to illegal part, each and every shopkeeper has put sheds outside their shop covering the public footpath . As my last option i have thought of removing my staircase but also going against all the shopkeepers and society to remove their sheds as well .
How can i make a way out of this?

Your and other shop owners construction is illegal. If the society is allowing the staircase by paying 30 % rent then make negotiations with society and try to find amicable solution.

The coverage by you or others is matter of setting and may not find any narration in documents signed by society.
If inflated rent fetches approvals from authority and society to you then consider IT.
Or negotiate hard and offending approach contemplated by you may help to negotiate..
Or agree on terms offered to you..
IT is entirely upto you.

Or approach a very able senior LOCAL counsel of unshakable repute and integrity specializing in society/Civil matters and well versed with LOCAL codes/laws/rules and having successful track record ……and worth his/her salt…and get everything demolished/removed as contemplated by you..

If the society's stair case is offered at 30% rent negotiate with the society and come to an amicable solution with the society. You and shop owners construction is illegal.
