If borrower did not get any notice or summon from court, can NBW issue in credit card default?
kavksatyanarayana (Expert) 06 March 2018
Generally NBW will not be given. but there are certain terms and conditions before issuing credit card. so check the letter issued to you while issuing the card. or consult a local well knowledged lawyer of your area.
Vijay Raj Mahajan (Expert) 07 March 2018
No NBW are not issued unless the accused received court summons and failed to appear and in that case too firstly bailable warrant issued failing to appear on those NBW issued by the court.
This is the usual practice.
Sudhir Kumar, Advocate (Expert) 07 March 2018

If the settlement is made then case is not maintainable in court. Appoint advocate and show all the settlement document. And if NBW is issued you have to go to court and cancel the NBW issued and fight out the case.

Thanks sir for your reponse, I have credit card with some bank and I did not make payment for three years because of loss of job as well as I moved from that adress to my home town between the mean time I did not get any notice or call from bank, I guess I was not on the address that's why I did not get any notice. After three years I proactive approached the bank and ask for settlement and they give me settlement letter and I made payment according to the letter and waiting for NOC. If any kind of civil suit was happened in past does is maintainable ? Furthermore, I asked from bank about civil suit they informed me that only notice was send on my adress and not providing me any information. What should I do now? Moreover, I selected for goverment job does it effect my police verification?
