Suggestion for bond in bsnl

(Querist) 19 January 2018 This query is : Resolved
Sir
I joined bsnl as tta in 2012 and bsnl made me to sign bond agreement of duration 5 years which was not correct as it was reduced to 2 years in 2001.they made me to sign in old format for 5 year. I resign in 2016 so nowsuggest what should i do. They are asking bond money from me. I have proof in form of letter from personnel of bsnl mentioning 2 year bond duration for those who join after 2001.
Plz give me legal advice.

Discuss the problem with some local lawyer and file a case against BSNL. provided you are sure that the bond period was reduced by official circulation of order by the competent authority of the BSNL corporate office.

You may inform the BSNL authorities of the norms. Anyhow, they cannot unilaterally enforce the bond but only through due process of law.

Asking, saying ……is verbal mode and difficult to establish.
How are they asking? Say; verbally or in writing by letter, notice or by legal notice?
Who is this; they? Say; some attorney of establishment in Line Management/HR personnel/Admin/Legal cell, Lawyer/Law firm?

IT shall be grossly wrong to run to file a case.
If a written communication has been supplied to you, revert in writing under proper acknowledgment and attach the said copy of personnel of BSNL and point out the variance in your case and ask to call back the…… said letter, notice or by legal notice by communication in writing to you!

Are you sure the bond executed was for 2 years and not 5 years?
T. Kalaiselvan, Advocate (Expert) 28 January 2018
If you rely upon the rules what you say to be in vogue and if you had got a reply in writing from the department to pay the bond amount as per the conditions of the employment offer letter, then you may first make a representation to the authority based on the reliable rules in this regard and seek relief of recalling their order to pay the service bond.

If you dont get a favorable reply and they still insist to pay then you may plan to initiate proper legal action as per law.

The employees' union also have copies of all notifications.
They can also be of help, if you wish.
