Stamp duty calculation

I purchased a under construction flat in resale. The original buyer bought it at Rs.5000/sqft. However, due to fall in rates u purchased it at rs. 3600/sqft. Now,on what rate stamp duty will be calculated?

Stamp duty is based on the guidelines value which could be ascertained at the registration department.

You want the area for 3600 sq ft or 5000 sq ft to be purchased, registered and possessed in your name, accordingly stamp duty has to paid.
Consult a local lawyer for proper analyses of facts and proceeding.

You are not clear in your facts.
You say that the original buyer bought the under-construction flat at Rs. 5000 per sq.ft. from the Builder.
Please clarify whether the original purchased has paid all the money payable to the Builder at Rs. 5000 per sq.ft. or not.
Otherwise, how much amount (total) so far the original buyer had paid to the Builder.
Now, are you required to pay to the builder, the balance amount at Rs. 5000/- to the builder or not?
If you are liable to pay the balance amount of Rs. 5,000/- per sq.ft. to the builder, then the Property will be registered at Rs.5,000/- per sq.ft. and you have to pay the Stamp Duty as per the value shown in the Sale Deed by the buyer.

Stamp duty should be paid on actual rate=total value settled between seller and buyer.
The circle rate/guidance value that is available in O/o Registering Authority and applicable on date of registration being the min. for calculation of stamp value...
