illegal construction

(Querist) 29 April 2017 This query is : Resolved
Hi,
I have my residence at Juhu, Mumbai. The land is in an Airport Zone. My house comprises of Groundfloor + 2 floors. I have been living here for more than 25 years and have the receipts of all my electricity and water bills and land ownership papers as well. The distance between both flats on the first floor was approx one feet.

Now my neighbour has reduced the gap between our balconies and extended his wall.
Hence now its almost touching the walls of my balcony. We tried to reason with him and asked him to stop the construction.

But he refused to enter into any negotiations and then later he started arguing and harassing us daily due to which we took action against him.

Action Taken:
We lodged an NC under Sec. 504 of IPC. I have also submitted a written complaint to Assistant Commissioner of Police (ACP) and the Deputy Commissioner of Police (DCP) as he tried to outrage my modesty. We have now been asked to approach BMC (Municipal Corporation) as illegal construction comes under their purview.

Considering these circumstances, we want some suggestion as to what is the required height and the area that can be occupied by an individual if the land falls under the Airport Zone.

Also what are the quick steps that we can take to resolve this issue as we don't want to opt for any lengthy procedure such as a court case. We just want the encroachment to stop and live in peace as the illegal construction is blocking the path of the air and light in our balcony. Suggestions would be very welcome. Thanks.
