N.I. Act jurisdiction

(Querist) 22 February 2017 This query is : Resolved
I filed a n.i. act complaint with court of wrong jurisdiction I.e. my bank account was maintained at different branch, but I taken it at different branch by mistake, therefore the jurisdiction of court was different. Summon have been issued by the incorrect jurisdictional court. Whether it would create any problem to me. How I can I rectify , if required. whether I should shift my account to the branch which is mentioned in the complaint.

Till this stage how didn't you know that the area of the branch has been mentioned by mistake. If there is a problem of jurisdiction of the court, that does mean you have mentioned the account with different city. Ask your lawyer to correct the mistake through an application and for the purpose of jurisdiction your case might get transferred. No need to shift your account, rather it shall have no effect on the case after shifting.

Bring the fact in notice of the court. your case might be transferred to the court having jurisdiction to try and decide the case.
