relieving and experience letter

Dear Experts,
After resign My company is not giving experience letter and relieving letter they said it is not in company policy. But new employer is demanding the experience and relieving letter. Pls tell me can i intiate any legal against my previous employer not to provide relieving & experience letter.

Law cannot come to your help for what is not mandatory in law.

Of course, relieving letter is a must. So, you can ask for relieving letter, but not in the name of experience letter. Service between the dates of your appointment and resignation can be treated as your experience on the job for which you were appointed.

Dear Dhingra sir,
i had already tried amicable to get my relieving letter and experience. but they not agree. pls clarify under which law & section i can file the complaint to get my relieving & experience letter

Your question is quite of academic nature for that appropriate reply has already been provided to you. But, you have not stated anywhere on account of what the company should give you experience and relieving letter. Background about your service and the mode of quitting that service is missing from your query.

So, discuss on the issue about quitting service, if you really were the employee of the company.
