Society matter

(Querist) 29 September 2016 This query is : Resolved 
In our society ex-committee resigned on 24/7/2016 and new committee took charge on 1/8/2016. Now the new committee is saying that Old committee should call the AGM and present the balance sheet in the meeting. Who should call the AGM and present the balance sheet? What is the legal opinion in this matter? Please reply at your earliest.

New committee should call and old should present its accounts.

As and when a new committed is elected and took the charge of the society the old committed should handover the all the records including balance sheet. but this is done. so now call for AGM and ask the old committee to present the balance sheet.

Subject to Maharashtra:
1. Quote: "society ex-committee resigned on 24/7/2016 and new committee took charge on 1/8/2016"

2. The above is not possible. New committee just simply CANNOT take charge in Seven days time.

3. A new Mg.Committee can be constituted ONLY after proper elections.

4. In the above Scenario, the new committee is null & void, for all legal purposes and CANNOT call AGM or present Accounts or whatever.
