Cheque

Sir due to some serious pressure by my enemies I gave an empty cheque to them by mentioning date 18/8/2015 after 13 months they had gone to the bank and honoured check and I got message Your cheque no. 563345 issued from A/c XXXX5519 for Rs.357000 has been returned due to ACCOUNT BLOCKED (SITUATION COVERED IN 21-25)as this

Sir cheque is valuable for max 6 months only na sir . is there any problem for me sir

if the date on cheque was mentioned as 18.08.2015 and the same was presented after 13 months of this date then you need not worry.

The validity of Cheque is now 3 months and if it has been presented after 13 months, you are not to be worried as the Cheque validity had expired on the date of its presentation.

Whether the date was mentioned on cheque in date column or mentioned otherwise (in their acknowledgement etc.)?

If date on cheque was 13.08.2015, it was stale cheque after 3 months, Bank was right in returning it.

Mr. Goyal! The bank has returned the cheque on another ground which is the core issue for the author.

Yes, the cheque was returned by another reason.

Author has not informed whether account was blocked by the account holder or not. He has not informed whether any cheque bounce case initiated?

Bank should have mentioned both reasons while returning.

Account holder need to take up matter with the Bank vigorously and if any cheque bounce case is filed, he should defend on the fact of cheque being stale.

If the Bank is PSU, should get all information through RTI.

Even if bank has not cited another reason, it shall not validate the mentioned cheque as the date is already mentioned on its face.

Now, you should reply to the drawer of the cheque accordingly inserting both the points.

A supplementary reply can also be sent clarifying therein that the account is closed since a long and no question arise to issue cheque favouring him.
