I came to know that my plot is in the map of acquired land for bareshwarasthan ganga pump nahar project in kahalgaon dist.Bhagalpur in the year 1980. As absentee landlowner i was not served any notice and had no knowledge of acquisition under 1894 act. I have come to know now that the compensation has been paid to some local person. I have given application to land acquisition officer my sale deed dt. 22.05.1965 with copy of survey record in 1976 and uptodate rent receipt with land possession cert. Issued by CO Kahalgaon. The LAO has replied in written to go to court to prove it. Can I get my land back if the compensation has been paid to stranger on forged documents under new 2013 LA act. The land has not been utilised for last 37 years. Or will i get the compensation which is mearly rs. 4700/- that was paid to stranger.

The land records have my name in new survey done in 1976 and rent receipt is uptodate 2016-17. The LAO has said that if i my documents are genuine i will only get the compensation paid by recovery from the stranger and i will not get my land back. Can i go to high court patna to get my land bach as i have not recd. any notice from LAO and get my land back as per LA Act 2014.

Show all documents to some senior lawyer dealing in the field and file case to return your land.

You have not told whether the land is still under your possession. If reply is yes then definitely you should go to Patna High Court under new law seeking either releasing the land or for acquisition under latest provisions.

The land possession certificate is issued in my name as on 06.08.2016. I want to know whether the sec 31(2) of old act 1894 is applicable in the case or will the 1894 act repealed and the new act 2013 will apply.
