Applicability of gratuity for training period

Ours is a spinning Mills. I would like to know Gratuity to be calculated trainers who drawn Stipend.

Or for Training Period of anyone be it Trainer, Trainee etc.....?

Trainees other than apprentices engaged as per Apprentice Act have the status of employees.

How and by which provisions these person are termed 'Trainee' and paid stipend?

If there are defects in their engagement as Trainee and contrary to the provisions then they might be eligible even if they are paid under the head 'Stipend'!
