Compromise under section 323 341

(Querist) 02 July 2016 This query is : Resolved
Hello respected members

I was charged with section 323 and 341 Ipc in a cross case registered against me by the opposite party. Earlier I had filed an fir against them charging them with section 308 and 334 Ipc as I was assaulted by a metal rod on my head during a minor scuffle perpetrated by them. Now I have to go abroad for further studies and want to get disposed off from these cases. what is the best and fastest way to get an acquittal and how long does it usually take in such matters. I am open to compromise acquittal as well. Thank you for your kind advice.

First check is that matter having merits for quashing of the fir (which is against you) and if no merits present than one way left by amicably settle that matter and than go for quashing from High Courts.

Thank you;

If both the parties agree then nest way is to go for quashing of Charge Sheet in high court.
In lower court acquittal even on compromise requires full trial which will take time.

Thanks everyone for the reply. Will go for quashing. Can some one give me an approximate time whole quashing procedure will take after compromise.

Mr. Rakesh,

In any court case, normally all estimates fail about time to take the case.

Few more questions:-

1)The charge sheet has already been filed so should I go for quashing of fir or chargesheet.
2)Also can both FIR's ie one done by me and cross fir, can be mentioned under the same petition for quashing..I mean can judge quash both FIR's/chargesheets together?
3) Also the offences in FIR against me i.e. Section 323 341 are compoundable and next hearing is due next month. What would be the best course of action for me I.e. Is there a possibility of Compromise acquittal on next court date or should I go for quashing only.

Respected Members..the only thing I want to know further is that my court hearing is due next month. So is it possible to get compromise acquittal in my case from trial court itself.
