How to separate a combined property with ones name

(Querist) 24 June 2016 This query is : Resolved 
My Sister's husband has a brother. They purchased a home before 15 years with combined names ( both of them) on home loan from bank. Now they got separated,his brother purchased new home for his family with mutual agreement.
Pl guide how to make the present home papers on his name only. i.e. how to delete his brothers name from this home.
all original purchase papers are at bank.

since the property was purchased in joint names hence both persons are joint owners and any one of them may not be called as single owner unless the right of the other person is not transferred to him. Inter vivos transfer may only take by a registered document . Your sister's husband' brother may execute a sale deed, gift deed , or a relinquishment deed in favour of your sister's husband
