nothing is preventing me to post the relevant facts.. sorry sir,
sir the matter is related to 28th bihar judicial civil judge examination,
my writ petition no. 21807/2015 was dismissed by high court patna only on the ground of estoppel.(as per my knowledge it is totally wrong because commission had not followed the constitution ie Art 234 and existing state rules 1955).
thereafter i filled slp no. 22249/2016 supreme court.but it was also dismissed{without giving any ground}.
facts of the case is:
". according to advertisement of 28'th bihar j. service and the rule 19 of the bihar civil service ( judicial branch)recruitment rules 1955 clearly said that , the marks obtained at the interview shall be added to the marks obtained at the written examination. the name of the candidates will then be arranged by the commission in order of merit….[ my total marks of mains and interview is more than qualifying marks]
2.. according to rule 15(c) of bihar civil services(judicial branch)recruitment 1955, "there shall be no qualifying marks in the viva test...[ i got 30 marks in interview]
in themean time of the process of examination before interview bpsc published a notification on behalf of high court that' 35 marks must be obtained in interview for pass the examination'(without follow the ART.234)and commssion can not change the rule in the midst of the game
3. Whether the high court erred in law by applying the doctrine of estoppel in a case where the process of selection of candidates was carried out in violation of the rules framed u/A 234 of the consti.
now in supreme court an other writ(c)294/2015 was heard by same bench. this matter is as similar to my case.this matter was sent to the larger.
my query is sir what can i do now... to tag my matter with writ 294/15 in larger bench or any other solution suggest me.pls
