(Querist) 05 May 2016 This query is : Resolved
state of maharashtra is going to file Review petition against our housing society in U L C matter.can we file caveat in supreme court in this matter?
what is the time limit for state government to file REVIEW PETITION already 16 months have been passed but they have not filed it.
please guide us in this matter.

It is only rare cases that a review petition is admitted. Even if admitted, there is no chance of any ex-parte decision. As such filing a caveat is waste.

in the review you need to mention the position of your building, why the society could not get permissions and all details if self sufficient, the court will just not dismiss the petition.
In case of dismissals without merit you can file review any time, as the delay need to be explained, as it is a settled law any delay is acceptable if your condonation application is sufficiently explaining the delay, tks.
