can i get this certificate from the court to prove i am a legal heir of deceased and use it where ever my heirship is challenged ?

sir,
my son is a nominee in a chs in navi mumbai.i jointly own a flat with my late wife. i want my son to get owner status for which i have to get a heirship certificate from court. there is no dispute and we dont have any other know heir type 1 or type 2. can we get a simple certificate from the court declaring my son as a legal heir of my late wife. all supporting documents are in order with me.

You can get legal heir certificate from local tehsildar / designated authority.

i am told legal heir certificate from tehsildar is not valid i will have to get one from the court only

Succession certificate from court is required in respect of movable property. In respect of immovable property, legal heir certificate is the requisite document.
By the way, is the son the only child.

Your wife's share shall be equally divided between you and your son.
You can gift/transfer/release/WILL your share
to your son.

is a heirship certificate an authentic document to prove you are a legal heir of the deceased by proving your relationship to the deceased by producing documents.
