Adoption - court order

(Querist) 01 December 2015 This query is : Resolved
Dear experts,

We have adopted a 2 years old baby girl from Govt. adoption center on last September, 19th 2015. Lawyer has submitted the related documents for the procurement of court order and we are eagerly waiting.

As I'm working abroad, for me getting another leave is a little bit difficult for another 1 year.

Do I need to be present in front of the judge at the time of court order issue or an authorization attested by the Indian consulate will do, so that my wife can get the document in my absence?

Please advise.

Regards,
Ajit

U R presence is mandatory in the court at the time of the order, a proxy cannot act on UR behalf.

Thanks Sainath for the quick reply.

Is it possible to extend the date for accepting court order, say to my next vacation in Novemeber 2016.

Regards,
Ajit

The rule is if a couple is adopting a child, the presence of both the husband and wife is a must.
Extending the date of the order U have to file a petition in the court citing valid reasons.

I fully agree with the experts, your presence is mandatory, however, seek extention of time through your lawyer.
