Sale deed validity with gpa query

(Querist) 12 October 2015 This query is : Resolved
Hi,

We purchased the house in 2010 and we are in procession now, which was sold by the GPA holder to some other person in 2007.

Here the sale deed executed date in sale deed document is 4 days before the death of the GPA grantor and the sale deed document is registered after the death of the grantor.

Here GPA is not coupled without interest but mentioned its irrevocable.

So can you please let me know what is the validity of the sale deed and how can we safeguard our house. Now the GPA grantor wife has filed the case.

Thanks,

Technically the sale deed is OK in your favor.

However, the possibility of challenging it on the ground that the same was registered after the date of death of the principal can not be ruled out.

When the stamp papers of the sale deed were purchased?

Whether the GPA (executant of Sale Deed) was alive on the date of execution and registeration of sale deed? Whether the principal has agreed to the transaction? Whether the Attorney has passed on the consideration to the titleholder/owner/grantor of attorney?
You have purchased the house in 2010 from the GPA, who is neither the title holder nor in possession?
The GPA has already sold the house to someone else in the year 2007???
Some information is missing to form proper opinion and advise.
