depositing a cheque with a different name

(Querist) 02 July 2015 This query is : Resolved

Respected Sir, My name is Anupam Raphael Biswas.I had a post office MIS which was in The name of Anupam Biswas. Two years back i had done KYC in the post Office in which my name was Anupam Raphael Biswas. Now since i needed money urgently i closed the MIS. I got a cheque from the post office with the name Anupam Biswas. Now the problem is that after KYC in all the banks my name is Anupam Raphael Biswas.I requested the post master to give the cheque in the name given in KYC but he said that the cheques are issued in the name in which the account was created. Now how will i get the cheque cleared by the bank. Do i need to do an Affidavit. If so will a simple notary do the job or i have to do it by a first class majistrate. Kindly help. Thanking You, Your's Sincerely, Anupam Raphael Biswas.

The bank may not agree to encash the cheque due to difference in the name of the payee of the cheque and the account holder. You may discuss the problem with the bank and if they do not agree one option for u is to open another account with a different bank in the name of Anupam Biswas and collect the cheque through that account. In order to avoid complication you may in ur application to open the account give the other name as alias.

In order to open a new bank account I need documents where my name is Anupam Biswas, but in all documents my name is Anupam Raphael Biswas.

How did u open the account with the present bank with ur name as Anupam Biswas? I think the bank will open the account on the basis of ur declaration in the application for opening the account.

When you changed the name subsequent to KYC, did you change your signature? If the signature is the same in both case, behind the cheque you first put the name as "Anupam Biswas' and sign across. Then repeat putting the next name. Your collecting banker can endorse as " 1st Payees endorsement guaranteed. 2nd Payees a/c will be credited" as per banking practice.

Your present Banker should agree to collect the cheque on your behalf, they may take a certificate on back of the cheque / credit slip that both person are same.
