Relieving from company

Hello,

I had resigned in my current company in Dec. 2014 and I have to serve notice period of 3 months.

Now that is after 2 months, HR has replied that my resignation is not accepted.

I am serving the notice period of 3 months and I have bond of 3 years which states that if I am leaving my company before 3 years, I have to pat certain amount.

In my resignation letter, I had mentioned that I am ready to pay bond amount.

When I had one to one discussion with HR, he said he cant relieve be as I have signed a bond and if I leave he wont give a relieving letter.

Please let me know what should I reply to HR.

HR did not accept the resignation just as a reason not to give me a reliving letter in future if I take legal action????

From my side, I am going by rules. Actually no notice period was mentioned on my offer letter, still I am serving 3 months and also ready to pay bond.

Please help me on this matter.

The company cannot retain you forcefully beyond the notice period, if you are serving notice period and also ready to pay the due bond amount in compliance with the terms of appointment & conditions of service bond.

Thank you Sir for your prompt reply.

Can you please guide me on how to reply to the mail in which HR said that they wont accept the resignation letter.

Can I tell them directly that :

"As per my resingation letter, I am serving the notice period of 3 months till 24th March,2015.

I am not willing to take back the resignation and I will not continue to work after notice period.

As per the aggrement signed on xx/yy/2013, I am ready to pay the bond amount of xx rupees.So please return back my original educational documents when I submit the bond amount."

Just write that your resignation should be treated as effective from so & so date, as that fulfills the requirement of terms of appointment/ resignation and also the conditions of bond, as you are prepared to pay the amount due as per the terms of bond for the duration short of bond period.

Ok Sir,

What if they deny to accept the bond amount as HR said to me that he will not accept the bond amount since they are not ready to accept my resingation. This all was done orally.

As of now they haven't mentioned in written that they will not accept the bond

I want to serve my notice period and pay the bond so that I fullfill are requirements from my side. They are not providing relieving letter, thats fine for me now becasue I think the reason they did not accept my resignation is that they are ready to relieve me but not give me a relieving letter.

Presumption have no definite answers. First take action as advised and wait for the outcome.

Hi all,

I had mailed my manager asking me my reliving date. He replied back asking "What you have aligned on this with HR" with HR in Cc.

I have prepared a reply like this :

Hi XXX,

YYY (HR Name) has denied to accept my resignation letter and give me a relieving letter.

But, I am already serving the notice period of 3 months starting from 24th December,2014 and ready to pay the amount of Rs xxxx as per the agreement signed on 2nd December,2013. So I can not accept the fact that HR has rejected my resignation.

Please let me know what should be the ideal reply.

I am ok with no relieving letter. Should I tell them this.

They are saying that they wont give me relieving letter because I am breaking the bond i.e. not serving for 3 years

But I am ready to pay the amount as mentioned in agreement when someone leave company earlier than 3 years.

My request is to relieve me on 24th March 2015 as per my resignation letter and return back my original marksheets when I submit the cheque.

Still there is no reply from them

They have my certificates. What step I should take if they refuse to give my cirtificates.

Please help.
