Legal heir

(Querist) 29 January 2015 This query is : Resolved
Dear Sir,

My father expired and my grandfather is alive. So, are we eligible as legal heir to my grandfather automatically or my grandfather has to accept it through legal formalities?

Your father's share in the property will devolve upon the children,if it was an ancestral property.

For self acquired property of your Grand Father, you have no claim till he is alive. If he expires intestate, you would inherit share of your father with other legal heirs.
