Redevelopment

(Querist) 22 November 2014 This query is : Resolved 
Our hsg. society at pant nagar, ghatkopar,Mumbai has a development agreement which is registered.
And there is unregistered individual agreement also. developer had agreed to give us 615 sft. now developer , another developer and ¾ th majority member of society, by tripartite agreement, reducing are to 405 sft.
This arrangement is not acceptable to few members who are not in minority.what legal remedy these minority members have?

If you have already paid any advance amount then you can file a Case against the developer in District Consumer Forum for deficiency of service.

has earlier agreement being cancelled with developer? on what basis members agreed to reduction in carpet area from 615 to 405 square feet . you will have to move court and challenge development agreement executed with new builder

Do not accept the new agreement with the developer with reduced carpet area. In case of need move to court. Consult local lawyer.

can majority members reduce area which reduces developers obligation & rights of the society,which may cause heavy economic loss to dissenting minority members?
