Notice from it deptt compliance management cell new delhi

Sir,
Nowadays some clients received a notice from Compliance Management Cell New Delhi for non filling IT Return for AY 2011-12, AY 2012-13 and fill reason in 'Compliance' in incometaxindiaefiling.gov.in website. How can reply above mentioned notice while taxable income are below 5.00 Lacs with refund and IT return have not filed.

Tax Department is widening their tax base. Tax Department has voluminous data about each and every PAN Holder. Using the data available with them, the Department is sending the notices to those who though having taxable income have not filed the return.

In terms of Section 139 of the I.T. Act, every person, whose total income during the previous year exceeded the maximum amount which is not chargeable to income tax, has to file the return.

If your client(s) have taxable income, then they are bound to file the I.T. Return.

At least now, after having received the notice, they should file their return.

One will not be able to escape by giving some reasons.

How can file IT return for AY 2011-12 and AY 2013-14 on basis of notice from it deptt compliance management cell new delhi. IF possible which section we can file IT return of a Salaried person for AY 2011-12, 2012-13.

If your client is a simply a salaried person, then in that event, the entire Tax Deduction might have been done by the employer. There will be no balance tax to be payable.

However, if the client apart from salary has also other incomes then he has to file the I.T. Return.

Take out the ITR Form Applicable, fill up in manual format, and submit it to the concerned I.T. Ward.

You may file a fresh ITR if not submitted earlier, and/or revised ITR may be filed.
