Good evening.
Please advice can Central/State government department providing Information documents, ask for postal charge from applicant i.e. amount towards postal charges including Stamp attached to envelop, speed post,Register charge? if so under which section/provision of RTI,Act,2005.

1. Under the provision of s. 27 (1) R.T.I. Act, 2005, the appropriate Govt may by notification in the official Gazette make rules to carry out the provision of this Act and u/s 27(2) of the Act, 2005 the rules can be made for such fixation of the cost/fees for to supply the information sought.

The charges can be determined and demanded by PIO/SPIO for copy of document(s)u/s 27 RTI Act, 2005, but not for the postal charges.

Payment of fee/Postal charges under RTI Act:

A citizen who desires to seek some information from a public authority is required to send, along with the application, a demand draft or a bankers cheque or an Indian Postal Order of Rs.10/- (Rupees ten), payable to the Accounts Officer of the public
authority as fee prescribed for seeking information. The payment of fee can also be made by way of cash to the public authority or to the Assistant Public Information Officer, against a proper receipt. The payment of fee to the Central Ministries/departments can also be made online through internet banking of State Bank of India or through Master/Visa Debit/credit cards.

The applicant may also be required to pay further fee towards the cost of providing the information, details of which shall be intimated to the applicant by the PIO
as prescribed by the Right to Information Rules, 2012. Rates of fee as prescribed in the Rules are given below:
(a) rupees two (Rs. 2/-) for each page ( in A-3 or smaller size paper) ;
(b) actual cost or price of a photocopy in larger size paper;
(c) actual cost or price for samples or models;
(d) rupees fifty (Rs.50/-) per diskette or floppy; and
(e) price fixed for a publication or rupees two per page of photocopy for extracts from the publication.
(f) so much of postal charges involved in supply of information that exceeds fifty
rupees.

Hence, if the postal charges for supply of information are more than Rs.50/- the applicant is required to pay the postal charges if demanded by PIO.

Thanks for the valuable information, but i would like to mentioned that in my case the CPIO asked the charge for envelop i.e. rs.5/- for sending intimation for payment towards Information.
It is also noticed that CPIO charges Rs.100/- for sending documents by RPAD, but actual postage stamp attached on envelop showing Rs.65/- [my specific request for sending documents by speed post only. Speed post required less charges than RPAD ]If CPIO could send the information documents by speed post the charge for Rs.35+ Receipt 10.
CAN THE ACT OF CPIO IS JUSTIFIED?

The information seekers are worried whether the Institution supplies the information or not. You are worrying about the expenditure in few hundreds. Had it known before hand in your first query I would have opted not to reply. Our time is more valuable than few hundreds for you. There are people who wage legal battle by spending lakhs of rupees to exercise their right over few hundreds worth matters. You are also free to do the same but not at our cost. Stop this thread.

Though Mr. Jagga Rao's best efforts to explain the author fully in an elaborate way has gone into the deaf ears of the author, the information was very much useful to many. It is high time the author realises his position and understands the replies.
