Title suit

(Querist) 25 July 2014 This query is : Resolved 
A title suit for a joint family property of 8 parties is filed by a legal hair(co-sharer) in the year 2012 in lower court. The common ancestor passed away long ago and no will was made by him. What will be the roles of the court and that of the other co-sharers? What are the legal proceedings of this case? Is there any possibility that court may declare that plaintiff is the owner of the whole property? In that case will the court make it mandatory for the plaintiff to give monitory compensation to other co-sharers?
Note:- Plaintiff possesses the property for more than 25 years and maintains the same by himself.

In fact on the property every Legal Heir has its right and in case the property can not be divided a monitory compensation also can be ordered for the appellant/ claimant in the property.

let trial court decide what ever it decides on the issue. Appeal need to contest only on vulnerable points and new facts cannot be included. appoint a competent appellate lawyer. then see how the case moves!

By merely holding possession of the property for 25 years, will not entitle the plaintiff to become the owner of the entire property, he has to obey the law and he can take away only his respective share in the property and not others also. Query appears to academic in nature, you may consult a local advocate or your tutor for further clarifications.
