Dear sir, if society take deemed conveyance by showing less members like society having total 16 members but due to illegle top floor they show only 12 members at the time of taking deemed conveyance what is position of that 4 members & what will happened at the time of redevelopment that they r considerd as a member or not? if this type of activity by society is allowed?

it is builder headache to get those flats vacated .
has society admitted the top floor owners as members of society? have they been issued share certificate?

If the society has not admitted them as members, they are living in the illegally constructed portion they can be deprived of the benefit in redevelopment at par with the members of the society.
