Fir quashing

(Querist) 22 January 2014 This query is : Resolved
In a sale deed where I was a witness, it was later found that seller had forged the voter ID for purposes of registration of sale deed to which I had no knowledge although I had identified the seller before the registration authority on insistence of buyer. An FIR was lodged wherein my name figured but In 2012 I was exonerated by the DSP AND SHO in investigation but now vide order of district court for reinvestigation, warrants against me were issued for 01.02.2014. what should I do? Go to High Court for quashing FIR or file anticipatory bail in trial court?? would the titled quashing of FIR be written??

What is the allegation on you?

First get anticipatory bail.
Once it is done then do not make hurry till submission of charge sheet.
If after submission of charge sheet your name appears in it then got for quashing of CS but not FIR as court does not prefer to quash FIR.

Well advised, first go for Anticipatory bail. Quashing Cs would be difficult, defend your case on merit if CS not quashed.

In this case where the seller of land was false one, I was only witness to sale deed. And I had identified the seller on insistence of the buyer who is My cousin. In trial case the buyer has been granted anticipatory bail by High court . The statement of false seller and original owner before the police indict the buyer as the one who gave money to false seller to act as bona fide vendor of land. I had although seen the voter ID of vendor wherein the name of original owner and photo of false owner was shown, the ID being fabricated, the fact which I could not fathom at the time of registry. Warrants against me issued by police but the trial has only directed to reinvestigate the case. What should I do?? Ihave filed case of stay of arrest at High Court.. Is it good case??? What should I do??
