Employer not relieving nor releasing benefit

(Querist) 20 November 2013 This query is : Resolved 
a co-op bank(employer) is not relieving employee on resignation without giving any reason or notice. it has been 9 months after resigning and till date i have no communication whatsoever on acceptance or otherwise. the salary payment has also been stopped from the subsequent month of resigning. I have given 4 reminders and no reply for that as well. the employer is due to me for gratuity, leave encashment and other benefits.
what would be appropriate step? kindly guide. also provide me with advocate contact details from bangalore.

if salary payment has been stopped stop attending office . issue legal notice to bank for payment of your benefits .

Send a final Legal Notice to the Chief of the "co-operative Bank" and made a copy to your present co-op bank, informing the attitude of the bank manager of the said bank.Failing which, you better to approach Labour Court for recovery of your benefits

If you have stopped attending to office after tendering notice of resignation and then final resignation and has been submitting reminders under proper acknowledgment then you should without any delay submit Notice of MD, Chairman of the bank and BM as well.
If you are member of employee’s union approach them too and let the Secretary/President also write to Chairman.

The BM should have replied to you on receiving notice of resignation, final resignation and guided the course of handover and relieving.
BM should have replied to reminders.


The establishment should have supplied the notice of Determination of Gratuity.
You can submit FormI for gratuity.

Leave encashment shall be computed in FNF statement/settlement.
