Divorce-husband refusing

(Querist) 10 November 2013 This query is : Resolved 
I have filed for divorce after suffering severe torture from hands of husband and M-I-L but my husband is dead against it.He wants me to be a servant all his life.My cross is over and husband`s cross is to begin.I want to submit some emails when husband admitted he hit me and apologised.But my lawyer says I cannot submit it now and I should have submitted it before my affidavit.What should I do?

You did not disclosed, whether you filed Divorce petition in Family Court or Civil court SD??

You can submit those e-mails and affidavits to prove tortures.

You have to file an application along with those documents well explaining that why in the first instance you could not file them and if the court is convinced, in the interest of justice, allow those documents on the record and later on, once these documents come on the record, you can prove them by filing additional affidavit. Generally such requests are accepted by the courts by putting nominal costs on you.
