(Querist) 15 September 2013 This query is : Resolved 
An accused in a cheque bounce case took a defence stand that he had already paid the amount of cheque in question so he can not be convicted. In fact the transaction shown by accused was a seperate one and it was not meant to clear amount of cheque in question. Now can this defence stand help accused in any way?

Burden lies on him to prove the payment. You can cross examine him when he leads his evidence.

He has to prove that he has payed the amount against the cheque.

You have to cross examine him to prove he did not pay chq amt. I
