(Querist) 09 October 2009 This query is : Resolved
Wife has been harassed by her husband and due to continous dowry demands by her husband and inlaws, she wants to lodge an FIR and fight case against her husband inspite of the fact that a lot of time is usually spent till decision by court. Please advice on what all I should do.
adv. rajeev ( rajoo ) (Expert) 09 October 2009
Geetika,
Advise her to file a complaint under DV Act. She can also file a complaint u/s 498 A of IPC regarding dowary harrashment.
court has to look in to all the cases not only one case.
She has to wait if she wants any justice.

The opinion of Rajeev is perfect. There is no limitation to file FIR in such cases.

The Dowry prohibition Act 1961 prohibits the giving or taking dowry.Section 3 of the Act specifies certain penalities. However as opined by Rajivji an Fir may be lodged and file a complaint u/s 498A of IPC.
