Regularisation of services -sponsored by employment exchange

(Querist) 02 April 2013 This query is : Resolved
Sir,
In A.P , GO.Ms.No.212 (Finance & Planning deptt.,) was issued to regularise the services of temporary/consolidated/dailywage appointments which are irregular and are not through Employment Exchange.
In the GO, in the conditions prescribed for regularisation, even the sponsorship by the EMPLOYMENT EXCHANGE is RELAXED.
So, My question is, for the regularisation of appointments which are sponsered by th employment exchange, is it necessary to use the same GO in which sponsorship is relaxed ? ( Appointed on ad-hoc basis in already sanctioned and clear vacant post on being sponcered by the Employment Exchange)

No. Such GO is not meant for the purpose other than mentioned therein so you cannot take the benefit as desired.

You may however try your luck in high court.

Thanks for the valuable reply sir.Actually I am sponsored by the employment exchange and got appointment, but on ad-hoc basis. My services are not regularised for long period and now tribunal and high court has directed to regularise my services from my initial appointment date. But now the respondents are insisting the said GO which is for regularizing irregular appointments, to me.How can they apply same Go for both Sponsored posts and non sponsored posts?(irregular appointments)
It is clearly mentioned in the GO that it is for regularising irregular post. But I am legally sponsored by the Employment Exchange. Please will you mention any citations of orders, acts, laws helpful to me to say that same GO is not applicable to me.

As I told you, try your luck in high court by filing Writ of Mandamus on the non compliance of Rule of Legitimate Expectation.
Raj Kumar Makkad (Expert) 03 April 2013
As you have already won from high court and department is not executing the judgment, you need not bring the judgments rather shall have to go to high court seeking contempt of court against the department officials.
