Hon'ble Member,

In a 138 NI Act case - I am from accused.

The complainant filed 3 different cases for 3 cheques which were issued by my client accused.

1) Now I want to file a document & orginical copy of document is single then how can I file the original document in all the three cases.

2) At present the case is for statement of accused and I want to examine accused, whether I am right or wrong

3) At the argument stage I want to argue all the 3 cases in together , If court allowed me what will be the effects

Pls guide urgent with provisions

You can file original documents in one case and take its certified copies for filing in another cases by getting it compared with file wherein original documents were filed. So far as evidence of the accused is concerned, it depends on case to case. In some cases it is advisable to bring some documents in the defence evidence and in other it is otherwise. You are the master of the case, decide keeping in view the facts of the case. Case can be argued at the same time in all 3 similar cases if court permits.riven

138 n.i.act is depend upon time limit.time has a specific role inthis matter so, first see all sides then safe yr client.

Dear Chetan, If your case is in the stage of questioning u/s. 313, Cr.P.C, you can file the statement of the accused in a detailed written format along with the original document and after recording the statement and marking of the document, you can get certified copy of the marked document from the court and use the same for other two cases as like original. Any statement given by the accused u/s.313, Cr.P.C., the complainant cannot be permitted to cross examine the accused based on his statement and the marked document and at the time of renderin judgement, the court shall give credintials and explanations in respect of the statement u/s.313, Cr.P.C and it wil be very useful for your caseriven
