Public notice

(Querist) 24 September 2012 This query is : Resolved 
There is a public notice in hindustan times 24.09.2012 issue and on page no. 9. I want to ask under what provisions of law can one publish photograph of the person who is just alleged and only FIR is filed of misappropriation of funds and cheating. Isn't it against the principles of natural justice and against our constitution.

it is case of HT that he has embezzled funds . it is to protect the public against his actions . he may say that i am manager in HT and on basis you may part with money for booking ads in newspaper and be defrauded . hence public notice .

You are also an advocate. Som you may better discuss by giving your own views, how you consider publishing of a public notice along with photograph of a criminal as against principals of natural justice and constitution? Why the general public be not made aware of a criminal? How the general public can identify a criminal without identification merely with reference to his name, which can be common amongs thousands of persons?

Respected Sir,

but in that notice it is said FIR is lodged it is not a full fledged order or judicial order that the person is convicted for the offence. If that is the case then each and every criminal whose case is pending then their photographs are also to be published by government in newspapers so that public are made aware for eg the episode of Crime Patrol Dustak that appeared on sunday. If that criminal photo is published in newspaper and TV then that businessman would have saved.
