Posting profile on matrimonial site before divorce completed

(Querist) 22 September 2012 This query is : Resolved
The divorce case filed from wife's side is going on in family court for last 2 years. She recently posted her profile with photo in an online matrimonial site showing status as "Awaiting divorce". It says the profile is created by parents.

Can I take any action against her? Is it possible to file a complaint in police cyber cell so as they can collect the details from online matrimonial site office, and also the locations where from she logged into? Most probably she will be access the site from her office so she can't say the profile was posted by parents without her knowledge.

Dear Swasti,

That would not help you in any way, even if she would have posted her profile herself. By stating "Awaiting divorce," she has stated a simple fact. Unless she remarries before grant of divorce, she cannot be held liable for violation of any law. No law bans posting of her profile anywhere on the web unless her profile indicates any lie on her part.

If she has posted her profile from her office, it is for her employer to take objection, if any, not you.

Thank you sir.

"By stating "Awaiting divorce," she has stated a simple fact"

But, here, her motive is to find another partner when the current marriage exists. Is it right in the eyes of law? I just want to use this face to convince the court that the desertion is from her side.

If I submit the printed copies of the profile in court, will she be forced to either accept or deny the fact that it was posted by her knowledge? If she says it was not posted by her, Can I file a police complaint that her photo & details misused by some unknown people and request to take action against them?

It seems you want to do every activity prematurely. Even if she admits that the posting of her profile is in her knowledge, I don't think that would help you in your court case. If you have doubt about her motive, let her remarry during the pendency of divorce case to give a matured shape to your doubts. If you express your doubt on her motive in the court, you will also have to prove that beyond any doubt.

About misuse of her details and photi, the question arises, how her parents can be held liable for misuse of her details and photo, when it is their liability as well as right to get her daughter married as soon as the divorce case matures?

I've filed RCR. Can I also post my profile in matrimonial site without any issues?

Can she take it into court saying posting profile for 2nd marriage & running RCR are contradictory acts?
