Mother's property

(Querist) 31 July 2012 This query is : Resolved
Hi,

My mother owns a BDA property registered in her name after my fathers death.
The BDA site was alloted to my father first and by the time the actual registeration was made he passed away and the property was alloted to my Mother.
Please let me know if this property is called a self acquired property in my mothers name or will it be considered as my fathers property.
If she wants to sell the property how will it be shared amonth the childrens (2 son's and 1 daughter)

thank you

Who paid the consideration amount? If it was your father then it would be an inherited property.
Mary Petreshia (Querist) 31 July 2012
till date we have paid a total amount of Rs. 300000 (3L)out of which my father had paid Rs.44,000. The rest was paid by mother.
Since my brothers did not want to take the risk after my father passed away. My mother and i paid the rest of the money. My mother had survived with the retirement money 2L after my father's death. Since i had started working i paid part payments.

it is your mother self acquired property . she has paid the consideration . if she sells the property it is upto her to whom she wants to give the sale proceeds

if she sells the property is it mandatory for my brothers and me to sign during the registration.
